Refund Policy

Important Note About Original Oil Paintings:

Original oil paintings are hand-painted works created with thick impasto, visible brushstrokes, texture, and layered color that give each piece its unique character and depth. These physical qualities may not be fully captured in digital photographs or on-screen reproductions. Colors may appear slightly different depending on the limitations of various digital technologies used in the production and transmittal of images, including but not limited to your monitor calibration, lighting conditions, and viewing distance. Subtle details, texture, and the true vibrancy of the paint are best appreciated in person. The artwork you receive will be the same piece shown in the photographs on the website.

 

Returns & Refunds

 

A. Open-Edition Prints & Merchandise

 

- Unused, undamaged open-edition prints and merchandise may be returned within 14 days of delivery for a refund of the item price. Buyer pays return shipping unless the item arrived damaged or was not as described.

- Open the package and photograph any damage before discarding packing materials.

 

B. Original Artworks & Limited-Edition Prints

- All sales are final except (1) in cases of damage in transit, (2) if the order is cancelled prior to shipment.

- If damaged, notify me within 7 days of delivery with clear photos of the artwork and the packaging. I will arrange repair, replacement, or full refund (including return shipping costs).

 

C. Refund Process

Refunds are issued to the original payment method within 14 business days of receiving the returned item and approving a damage claim; or in the event of order cancellation prior to shipping.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms or your purchase shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida. You consent to personal jurisdiction and venue in those courts.

 

Chargebacks, Disputes, and Fraudulent Orders

I fully cooperate with payment processors and card issuers on legitimate disputes. However, purchasing artwork and then initiating a chargeback or dispute while keeping the artwork constitutes theft by fraud under Florida law (Fla. Stat. § 812.014) and may also violate federal mail/wire-fraud statutes.

If you file a chargeback or claim “unauthorized transaction” or “item not received” after the tracking shows successful delivery (or after you have taken possession), I will:

  1. Provide the card issuer or platform with full evidence of shipment/delivery, signed proof of receipt (when available), and all order communication.

  2. Pursue recovery of the artwork and all associated costs (including return shipping, administrative fees, and reasonable attorney fees).

  3. Report the incident to the Florida Department of Law Enforcement, the Internet Crime Complaint Center (IC3), and the cardholder’s issuing bank for suspected fraud.

  4. Permanently ban the individual and any associated accounts or shipping addresses from future purchases.
